It is bottomed on the common law principle that the accused is transferred to the friendly custody of his sureties and is at liberty only by their permission.
Juvenile Justice: At this time, juveniles do not need to be bonded out, although in South Florida statistics indicate that "juvenile crime" causes approximately 20% of all crime in the community. Most juveniles are placed in the care of their parents or guardians. However, in some states requiring bonds for juveniles are being considered and there are indications that such bonds to release a juvenile from "jail" would lower over all crime statistics. Many juveniles commit "serial" crimes and the criticism is that the Juvenile Justice system is a "swinging door" for juveniles until they can be prosecuted as adults. Juveniles commit the same crimes as adults, however, they are not often prosecuted, found guilty, or sent to a Juvenile Justice facility.
